These Terms of Service ("Terms") govern your access to and use of the Mailexs Service provided by Synthfy LLC, operating the Mailexs platform ("Mailexs", "we", "us", or "our"). By creating an account or using the Service, you agree to these Terms.

1. The Service

Mailexs is a cold-email outreach platform that lets you connect or purchase email mailboxes, build multi-step sequences, rotate sending across inboxes, and manage replies. You are responsible for the content you send and for compliance with all applicable laws.

2. Eligibility & Accounts

You must be at least 18 years old and able to form a binding contract. You are responsible for safeguarding your account credentials and for all activity under your account.

3. Acceptable Use

Your use of the Service must comply with our Acceptable Use & Anti-Spam Policy, which is incorporated into these Terms. Violations may result in immediate suspension or termination.

4. Subscriptions & Billing

Paid plans are billed in advance on a recurring monthly basis unless otherwise stated. Your subscription renews automatically until cancelled. Domain and mailbox purchases made through the Service may be billed separately and are subject to the terms of the underlying providers. Fees are exclusive of taxes where applicable.

You can cancel at any time from your dashboard; cancellation stops future renewals. See our Refund Policy for refund eligibility.

5. Customer Responsibilities

You represent that you have a lawful basis and any required consent to contact the recipients you upload, that your messages include accurate sender information and a working opt-out, and that you will honor unsubscribe and suppression requests promptly.

6. Service Availability

We work to keep the Service available but do not guarantee uninterrupted operation. We may modify, suspend, or discontinue features with reasonable notice.

7. Disclaimers & Limitation of Liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Mailexs and Synthfy LLC will not be liable for indirect, incidental, or consequential damages, and our total liability will not exceed the fees you paid in the three months preceding the claim.

8. Indemnification

You agree to indemnify and hold harmless Synthfy LLC from claims arising out of your content, your use of the Service, or your violation of these Terms or applicable law — including claims relating to spam complaints or unlawful outreach.

9. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Venue for disputes lies in the courts located there.
